These Terms and Conditions ("Terms") govern your access to and use of the HotelsDigitalMenu.com website, platform, and services (collectively, the "Service") provided by Hotels Digital Menu. The Service operates globally and is designed to serve Establishments and End Users in any country or jurisdiction.
By accessing or using the Service — whether as an Establishment or an End User — you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. Definitions
- Establishment:
A hotel, resort, restaurant, café, or similar hospitality or food service business that registers an account to create and manage digital menus on the platform. - End User:
A guest, customer, diner, or any individual who accesses a digital menu via a QR code or link provided by an Establishment. End Users interact with the Service as consumers viewing menus and may also submit feedback, ratings, or contact an Establishment through platform features. - Content:
Menus, images, videos, text, descriptions, prices, allergen notices, nutrition details, and any other material uploaded or created by Establishments. - QR Code:
The unique digital code generated by the Service linking to an Establishment's digital menu. - Service:
The HotelsDigitalMenu.com platform, website, tools, and related services offered by Hotels Digital Menu./li>
2. Services Provided
Establishments may use the Service to:
- Register an account and create a digital menu profile
- Upload and customise menus with photos, videos, descriptions, prices, allergens, and nutrition information
- Generate unlimited downloadable QR codes for printing and placement
- Update menus in real-time — changes reflect instantly, no new QR code needed
- Access multilingual and multi-currency features where available
- Receive feedback and ratings submitted by End Users
End Users may use the Service to:
- Scan QR codes or follow shared links to view digital menus on any device — no app required
- Browse menus, view item details, allergens, and prices
- Submit feedback or ratings to Establishments through available platform features
- Access the Service freely, without creating an account
3. Account Registration and Responsibilities (For Establishments)
- Register with accurate, current, and complete information
- Maintain the confidentiality of your credentials and take responsibility for all account activity
- Be at least 18 years old or hold legal authority to bind your Establishment
- Notify us immediately of any unauthorised account access or security breach
- Keep your contact details and billing information up to date
4. End User Rights & Responsibilities [End Users]
- 4.1 ACCESS & USE
- You may access digital menus freely by scanning QR codes or following shared links
- No account registration is required to view menus
- The Service is intended for personal, non-commercial menu browsing and interaction

4.2 FEEDBACK & RATINGS
- You may submit feedback, ratings, or comments where such features are enabled
- Feedback must be honest, respectful, and not misleading. Abusive, defamatory, or spam submissions are prohibited
- By submitting feedback, you grant Hotels Digital Menu a non-exclusive, worldwide, royalty-free licence to display it within the platform
- 4.3 PROHIBITED CONDUCT
- Do not scrape, copy, reproduce, or commercially exploit content or data from the Service
- Automated access, bots, or scripts are prohibited without prior written consent
- Do not interfere with or damage the Service or its infrastructure
- Impersonating another user, Establishment, or Hotels Digital Menu representative is strictly prohibited
- 4.4 END USER PRIVACY
- Menu browsing is generally anonymous. Limited information may be collected when features like feedback are used — see Section 14
- We do not sell End User data to third parties
- Users in jurisdictions with specific data rights (such as EU/GDPR or California/CCPA) may contact us to exercise those rights
5. Content Ownership and License
- Establishments retain full ownership of their Content
- By uploading Content, you grant Hotels Digital Menu a worldwide, non-exclusive, royalty-free licence to host, display, and distribute it solely to provide the Service
- You warrant that your Content does not infringe any third-party intellectual property, privacy, or other rights, and complies with all applicable laws
- You are solely responsible for the accuracy, legality, and appropriateness of your Content — including prices, allergen information, and nutritional data
- We reserve the right to remove Content that violates these Terms or applicable law
6. QR Codes
- QR codes are generated for your exclusive use and remain linked to your active menu
- You may download, print, and distribute QR codes freely within your premises and marketing materials
- QR codes are static links — menu updates are reflected instantly without requiring new codes
- QR codes for inactive or terminated accounts will no longer function
7. Prohibited Uses
All users — Establishments and End Users — agree not to:
- • Use the Service for any unlawful purpose or in violation of applicable law or regulation
- • Upload harmful code, viruses, malware, or disruptive content
- • Infringe upon intellectual property rights of Hotels Digital Menu or any third party
- • Engage in harassment, abuse, threats, or harm toward any individual or entity
- • Attempt to gain unauthorised access to the Service, its servers, or related systems
- • Use automated scripts, bots, or crawlers without prior written permission
- • Misrepresent your identity, affiliation, or credentials on the platform
- • Use the Service to send unsolicited communications or conduct phishing activities
We reserve the right to suspend or permanently terminate access for any violation.
8. Fees & Payment
- Certain features may require a paid subscription — see our Pricing page for current details
- All fees are displayed in the applicable currency at the time of purchase
- Payments are generally non-refundable except as stated in our Refund Policy
- You are responsible for all applicable taxes, duties, or levies in your jurisdiction
- We reserve the right to modify pricing with reasonable advance notice
9. Termination
- Establishments may close their account at any time via account settings or by contacting us
- We may suspend or terminate access for breach of these Terms, non-payment, or sustained inactivity, with prior notice where practicable
- Upon termination, your Content may be deleted and access revoked — we recommend exporting content before closure
- Sections 5, 7, 11, 12, and 15 survive termination and continue to apply
10. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis, without warranties of any kind — whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, timely, or fully secure. Hotels Digital Menu is a technology platform intermediary and does not endorse, verify, or guarantee the quality, safety, or legality of any Establishment's products, services, or Content.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Hotels Digital Menu and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from your use of or inability to use the Service.
Our total aggregate liability for any claim shall not exceed the total fees paid by you in the twelve (12) months immediately preceding the claim.
Hotels Digital Menu is not responsible for transactions, disputes, orders, or payments between Establishments and End Users — these occur entirely outside the scope of our platform.
12. Indemnification
You agree to defend, indemnify, and hold harmless Hotels Digital Menu, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your Content or use of the Service
- Your violation of these Terms
- Your violation of any third-party right, including intellectual property or privacy rights
- Any false or misleading information you provide through the Service
13. Intellectual Property
All intellectual property rights in the Service — including the platform, software, design, branding, and associated materials — are and remain the exclusive property of Hotels Digital Menu or its licensors.
Nothing in these Terms grants you any right, title, or interest in the Service's intellectual property beyond the limited right to use it as expressly set out here.
"HotelsDigitalMenu," the Hotels Digital Menu logo, and related marks are trademarks of Hotels Digital Menu. You may not use these marks without prior written consent.
14. Privacyc
Your use of the Service is governed by our Privacy Policy, which describes how we collect, use, store, and protect information. End Users' menu browsing is generally anonymous unless features such as feedback are used.
We are committed to complying with applicable international data protection standards. Depending on your location, specific rights may apply under:
- GDPR — for users in the European Economic Area
- UK Data Protection Act 2018 — for users in the United Kingdom
- CCPA — for users in California, USA
- Other applicable local data protection laws in your country

15. Changes to Terms

Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
16. Governing Law & Dispute Resolution
OUR GLOBAL & NEUTRAL APPROACH
Hotels Digital Menu is a globally accessible platform serving Establishments and End Users across multiple countries. These Terms are interpreted and applied in accordance with internationally recognised commercial principles and standards — not the laws of any single country.We aim to resolve all disputes amicably and in good faith. If you have a concern, please contact us at info@hotelsdigitalmenu.com so we may attempt informal resolution first. Where informal resolution is not achievable, disputes may be referred to binding arbitration under internationally recognised arbitration rules, or to the courts of a mutually agreed neutral jurisdiction — unless a specific mandatory legal framework applies in your country of residence.
-Nothing in this clause limits any statutory rights you may have under the laws of your own country that cannot be excluded or modified by agreement. This globally neutral approach is designed to provide fair and accessible dispute resolution for all users, regardless of where they are located.
17.General Provisions
- ENTIRE AGREEMENT
These Terms, together with our Privacy Policy and any applicable Pricing terms, constitute the entire agreement between you and Hotels Digital Menu with respect to the Service. - SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect. - WAIVER
Our failure to enforce any right or provision shall not constitute a waiver of that right or provision. - ASSIGNMENT
You may not assign or transfer any rights under these Terms without our prior written consent. We may assign our rights to a successor entity without restriction. -
LANGUAGE
These Terms are written in English. In the event of conflict between a translated version and the English version, the English version shall prevail.
