• Establishment:A hotel, resort, restaurant, or similar business that registers an account to create and manage digital menus.
• End User:A guest, customer, or any individual who accesses a digital menu via QR code or link provided by an Establishment.
• Content:Menus, images, videos, text, descriptions, prices, and any other material uploaded or created by Establishments.
• QR Code:The unique code generated by the Service linking to an Establishment's digital menu.

• Sign up and create an account.
• Upload, create, and customize digital menus (including photos, videos, descriptions, prices, allergens, and nutrition information).
• Generate unlimited downloadable QR codes for printing and use.
• Update menus in real-time, with changes reflected instantly.
• Access multilingual and multi-currency features where available.

• To use advanced features, you must register an account with accurate information.
• You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
• You must be at least 18 years old or have legal authority to bind your Establishment.
• You agree to notify us immediately of any unauthorized use of your account.

• End Users may access digital menus freely by scanning QR codes or links.
• End Users are not required to create an account.
• Use is limited to viewing menus provided by Establishments.
• End Users agree not to misuse the Service (e.g., no scraping, automated access, or interference).

• Establishments retain full ownership of their Content.
• By uploading Content, you grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute it solely to provide the Service (e.g., displaying menus to End Users).
• You represent and warrant that your Content does not infringe third-party rights (including intellectual property, privacy, or publicity rights) and complies with all applicable laws.
• You are solely responsible for the accuracy, legality, and appropriateness of your Content (e.g., prices, descriptions, allergen information).
• We may remove Content that violates these Terms or applicable laws.

• QR codes are generated for your use and remain linked to your menu.
• You may download, print, and distribute QR codes freely.
• QR codes are static links; updates to menus do not require new QR codes.

• Use the Service for unlawful purposes or to promote illegal activities.
• Upload harmful code, viruses, or malware.
• Infringe intellectual property rights.
• Harass, abuse, or harm others.
• Attempt to gain unauthorized access to the Service.
• Use automated means to access or scrape the Service without permission.
• Misrepresent your identity or affiliation.

• Certain features may require a subscription or payment (details on our Pricing page).
• Payments are non-refundable except as stated in our refund policy.
• You are responsible for all taxes applicable to your use.

• Establishments may terminate their account at any time.
• We may terminate or suspend access for breach of Terms, non-payment, or at our discretion.
• Upon termination, your Content may be deleted, and access revoked.

The Service is provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure.

To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.

Our total liability shall not exceed the amount paid by you in the 12 months preceding the claim.

We are not responsible for interactions between Establishments and End Users (e.g., orders, payments, disputes occur outside the Service).

You agree to indemnify and hold us harmless from claims arising from your Content, use of the Service, or violation of these Terms.

Your use is also governed by our Privacy Policy, which explains how we collect and use information.

End Users' interactions (e.g., viewing menus) are generally anonymous unless features like feedback are used.

We may update these Terms. Continued use after changes constitutes acceptance. Significant changes will be notified via email or the platform.

These Terms are governed by the laws of Kenya or a jurisdiction with similar guiding laws.
